Terms and Conditions

| General |
The following Terms and Conditions do not affect your statutory rights as a consumer.
By placing you order with us you accept these Terms and Conditions.

| Definitions |
SeaBerryLQ is a Trade Mark of LQ UK LTD.
LQ UK LTD registered in England under company number 6467653 with registered office at 72 New Bond Street, London W1S 1RR, UK.

|
| Orders |
| The goods which may be purchased from us may be limited in stock and are subject to availability.
Due to restrictions we could not accept orders for delivery to addresses outside of the mainland UK.
We reserve the right not to accept any order in which case we shall not have any further obligations to you regarding any such order placed by you. We will not accept orders from persons under the age of 18.
In the event the delivery address supplied by you is found to be incorrect in any way or the postcode provided by you is invalid, goods will be dispatched at your own risk and we shall have no responsibility or liability to you for any late or non-delivery of goods.

| Price and Payment |
| Prices are quoted in pounds sterling and are subject to change at any time. The prices are not subject to VAT, unless otherwise specified. Any delivery charges are additional.
We cannot dispatch any goods until we have received the necessary payment. All credit/debit card payments are subject to validation and authorisation by the card issuer. If your card issue refuses to authorise payment, we will not be liable for any delay or non-delivery.

| Delivery |
| Standard charge is £6.99 for all case deliveries up to 20 kg or £3.49 per bottle for bottle deliveries within the UK mainland. Due to the many different restrictions we deliver our products only within UK mainland. We may use an independent courier.
Orders received and fully paid by 1pm will be dispatched the next working day. Standard delivery time is 5 working days provided that the item is in stock.
You may ask us to leave your order at your neighbours or somewhere at the delivery address, but the goods are left at your risk.
The courier will only attempt to deliver ordered goods twice, after which you will be responsible for making your own arrangements with the courier or collection from them within 21 days of the date of your order placed with us.
When you/the recipient have received the goods at the address specified in your order, the risk of damaged to the goods shall pass to you.
Couriers are unable to deliver to PO Box numbers including BFPO.

| Age Restriction |
| It is illegal to sell alcohol products for persons under 18 years old. Anyone under 18 purchasing or attempting to purchase alcohol is committing an offence (section 149 Licensing Act 2003). By placing an order you confirm that you are at least 18 years old. The recipient should be ready to prove that he is over 18, otherwise the courier has to refuse the delivery. Acceptable ID are: a passport, a photo driving license or a prove of age scheme card carrying the PASS logo. |

| Cancellation of Orders and Returns |
| You may cancel your order for any reason within 7 working days after the goods received. To cancel your order please e-mail us at info(at)SeaBerryLQ.co.uk and receive the delivery address for returning goods from us. Then return the goods to the address provided by us within 30 days of receiving the goods along with a letter explaining why you are returning them.
We shall refund you for the goods returned to us within 30 days from the date we received the returned goods from you in saleable condition in its original, undamaged packaging.
In the event of cancelation you are liable for the costs of initial delivery of the goods to you and returning them to us.

| Breakage, Shortages and Substituted Goods |
| Any breakage, incorrect goods and/or shortage in respect of the goods ordered by you must be notified to us by e-mail info(at)SeaBerryLQ.co.uk within forty eight hours of receipt of such goods. |

| Our Liability to you |
We shall have no responsibility or liability for any late or non-delivery of goods ordered where the delivery address supplied by you is incorrect in any way.

| Our total liability to you for breakage, non-delivery, any shortage or defects in respect of accepted orders for goods is limited to: |

delivery of the goods in the case of non-delivery, |
|
replacement in respect of breakages or defects, |
|
delivery of missing goods in respect of shortages, |
|
crediting you with the value of the goods subject to breakage, non-delivery or defects. |
| Thus, in terms of alcohol intake, one measure of whisky is about the same as one half pint of 3.6% abv beer. |

| We have no responsibility or liability to you in respect of any defects in the quality of the goods delivered, unless you give us full details of the defects within seven days of when the defect became apparent to you or ought to have become apparent to you.
Our total liability to you in respect of any products bought from us is limited to crediting your bank account or credit/debit/charge card with the amount debited in respect of such products.
We exclude, to the fullest extent possible under the law, any and all liability arising from errors (including typographical errors) contained in, or any omissions from, any publications issued by us relating to the goods ordered by you.

| Privacy Policy |
| Any information that you provide to us about you, such as name, address, purchase details, etc. will not be given or sold to any other organisation without your consent.
We are committed to protecting your privacy. We will only use the information that we collect about you lawfully in accordance with the Data Protection Act 1998 and Directive on Privacy and Electronic Communications 2003.

| Cookies |
| We use cookies on our web site, which are only used to store basic information about your order. It does not store password or credit card information. It is possible to view our site without providing any personal details. However, if you prevent us from placing Cookies on your computer during your visit, or delete the Cookie from your computer, then it will not be possible to use the site effectively because the system relies on the Cookie to keep track of the current order and your session ID.
Please note that we do not use Cookies to retrieve personal information about you from your computer, unless the information has been knowingly and willingly been provided by you.

| Force Majeure |
In case of any event or circumstances beyond our reasonable control we shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any defects or damage to goods ordered.

| Invalidity |
| In case if any part of these Conditions is unenforceable (including any provisions in which we exclude our liability to you) the enforceability of any other parts of these Conditions shall not be affected. |

| Governing Law |
| The contract between us for the sale and purchase of goods ordered shall be governed by and construed in all respects in accordance with English law and the English Courts shall have jurisdiction to resolve any disputes between us. |

| All rights in the design and any items contained within this site including its trademarks, intellectual properties, pictures and any text are solely owned by LQ UK LTD and may not be used for any other purpose. |

| Others |
